This End-User Licence Agreement (the “EULA”) is a legal agreement between you and POVBRUDDA LTD (“CruiserFM”, “we”, “us” or “our”) for your use of the CruiserFM mobile application and related services (together, the “App”). This EULA is between you and POVBRUDDA LTD only, not Apple Inc. (“Apple”). POVBRUDDA LTD, not Apple, is solely responsible for the App and its content.
1. ACCEPTANCE AND ELIGIBILITY
By downloading, installing or using the App, you agree to this EULA and our Privacy Policy at https://bruddapov.com/privacy/. If you do not agree, do not use the App. You must be legally capable of entering this agreement and meet any minimum age required by the laws where you live. The App is not directed to children under 13.
2. LICENCE
Subject to this EULA, POVBRUDDA LTD grants you a limited, personal, revocable, non-exclusive, non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may also be accessed and used by other accounts associated with the purchaser through Family Sharing, volume purchasing or Legacy Contacts where Apple permits this.
You may not copy, modify, reverse engineer, decompile, distribute, sell, rent, sublicense, circumvent security or access controls, interfere with the App or its networks, or use the App to build a competing service, except to the extent that applicable law expressly allows such conduct.
3. ACCOUNTS AND SECURITY
You are responsible for activity through your profile and for keeping your device and access credentials secure. Do not share purchase credentials, signed access tokens, radio tickets or cruise access codes with anyone who is not authorised to use them. Information you provide must be accurate and must not impersonate another person or organisation.
4. SAFE AND LAWFUL USE
CruiserFM is intended to support communication and coordination, not to replace your attention, judgement or responsibility as a driver. You must obey traffic laws, road signs, closures, official instructions and local rules about mobile-device use. Do not hold or operate a phone while driving where prohibited or unsafe. You remain responsible for your vehicle, route and decisions.
Routes, estimated times, live positions, radio range and other location-based information may be delayed, incomplete or inaccurate. Never rely on the App for emergency services, collision avoidance, traffic-law compliance or safety-critical navigation.
5. USER CONTENT AND CONDUCT
You retain ownership of content you provide. You grant POVBRUDDA LTD a limited, worldwide licence to host, transmit, process and display that content only as needed to operate, secure and improve the App.
Objectionable content and abusive behaviour are not tolerated on CruiserFM. You must not use the App to create, post, send or transmit threats, harassment, bullying, hate speech, racism, discrimination, sexually explicit material, unlawful material, dangerous instructions, emergency impersonation, intellectual-property infringement, malicious code or content that interferes with safe driving. You must not stalk, track, impersonate or expose another person without lawful authority or consent.
We may filter, reject or remove objectionable content at any time. Users can report objectionable content or abusive users and can block users to stop unwanted contact. We review user reports within 24 hours of receipt and take any action reasonably necessary to protect users and the service. This may include removing content, restricting features, suspending an account or permanently banning the user who provided the offending content or engaged in abusive behaviour.
6. LOCATION, AUDIO AND PRIVACY
Features such as nearby radio, Friends Radio, routes and active cruises may require location and microphone access. You choose whether to grant device permissions, but a feature may not work without the permission it needs. Friends Radio may deliver your live voice to accepted friends regardless of distance. When you are inside a Safe Area, CruiserFM prevents your live radio location from appearing on friends’ maps while keeping radio available. The App may still process location needed to operate the radio, as described in the Privacy Policy at https://bruddapov.com/privacy/.
Versions of CruiserFM for iOS that include TikTok advertising measurement request Apple’s App Tracking Transparency permission. You may decline tracking and continue to use the App. Accepting this EULA or the Privacy Policy does not grant tracking permission. 7. SUBSCRIPTIONS AND BILLING
Paid plans are auto-renewable subscriptions processed by Apple. Current radio-range and group-hosting plans renew monthly. For this plan update, existing subscribers retain their current renewal price and billing period while their subscription remains active. Existing weekly radio plans continue to renew weekly unless the subscriber chooses and confirms a replacement through Apple. Current monthly radio plans cover 1, 2, 5 or 10 miles; current hosting plans are Host 5, Host 15, Host 100 and Host 500. Host 15 includes 10-mile nearby radio for both new and existing active subscribers. Existing active Host 50 and Host 200 subscribers retain their hosting capacity, included radio and renewal price, although these plans are no longer shown among the current choices.
The 1-mile monthly radio plan offers a one-week free trial where Apple displays it and confirms eligibility. After the trial, the subscription renews at the monthly price shown by Apple unless cancelled. Changing plans does not guarantee a new trial. Before confirmation, Apple displays the subscription title, duration, price and any introductory offer for your App Store storefront. Payment is charged to your Apple Account when you confirm, or after an applicable free trial ends. Unless you cancel at least 24 hours before the end of the current billing or trial period, the subscription renews automatically and Apple charges the renewal price to your Apple Account. You can manage or cancel a subscription in your Apple Account subscription settings.
Any active paid range or hosting plan currently unlocks Friends Radio. Features, plan availability and eligibility may depend on the installed App version, account status, region and current App Store offering.
Apple’s applicable payment, refund and subscription terms also apply. Except where required by law or Apple’s policies, POVBRUDDA LTD does not process refunds for purchases made through Apple. Ending this EULA does not itself cancel an Apple subscription; you must cancel it through Apple.
8. THIRD-PARTY SERVICES AND TERMS
The App depends on services provided by Apple and other suppliers, including network, map, routing and infrastructure providers. Their services may be governed by their own terms. You must comply with all applicable third-party terms when using the App, including your wireless-data agreement and the Apple Media Services Terms and Conditions. Third-party services may change, become unavailable or contain inaccuracies outside our control.
9. MAINTENANCE AND SUPPORT
POVBRUDDA LTD, not Apple, is solely responsible for maintenance and support for the App as required by applicable law. Apple has no obligation to provide maintenance or support. Support requests may be sent to [email protected].
10. WARRANTIES
Nothing in this EULA excludes any warranty or consumer right that cannot lawfully be excluded. Subject to those rights, the App is provided on an “as available” basis. We do not promise uninterrupted, error-free or universally available operation, or that location, route, radio or third-party information will always be accurate.
If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund any purchase price paid for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. POVBRUDDA LTD is responsible for any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to an applicable warranty.
11. PRODUCT CLAIMS
POVBRUDDA LTD, not Apple, is responsible for addressing claims by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to meet a legal or regulatory requirement, and claims under consumer-protection, privacy or similar laws. Nothing in this EULA limits our liability beyond what applicable law permits.
12. INTELLECTUAL-PROPERTY CLAIMS
If a third party claims that the App or your possession or use of it infringes that party’s intellectual-property rights, POVBRUDDA LTD, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
13. LEGAL COMPLIANCE
You represent and warrant that you are not located in a country or region subject to a United States Government embargo or designated by the United States Government as a “terrorist supporting” country or region, and that you are not listed on any United States Government list of prohibited or restricted parties. You must use the App only in compliance with applicable laws.
14. SUSPENSION AND TERMINATION
This EULA continues until terminated. You may terminate it by deleting the App and stopping use. We may immediately suspend or permanently terminate your access if you provide objectionable content, abuse another user, materially or repeatedly breach this EULA, create a safety or security risk, fail to pay for a paid service, or if we must do so to comply with law. Where appropriate and consistent with user safety, we may give notice and an opportunity to remedy the issue. Sections intended by their nature to survive termination continue to apply.
15. LIABILITY AND CONSUMER RIGHTS
Nothing in this EULA excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. Subject to that, POVBRUDDA LTD is not responsible for losses caused by unsafe or unlawful driving, ignored road conditions or instructions, use of the App contrary to this EULA, events outside our reasonable control, or third-party services.
If you are a consumer, you keep all mandatory rights under the law of the country where you live. This EULA is governed by the laws of England and Wales, but that choice does not deprive you of mandatory protections available in your home country. Courts with jurisdiction under applicable consumer law may hear disputes.
16. CHANGES
We may update the App or this EULA to reflect changes to features, law, security or our business. If a change materially affects your rights, we will provide reasonable notice where required. Continuing to use the App after an updated EULA takes effect means you accept it, unless applicable law requires another form of consent.
17. APPLE AS THIRD-PARTY BENEFICIARY
You and POVBRUDDA LTD acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA. When you accept this EULA, Apple has the right, and is deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.
